Designated establishments: what the energy efficiency law asks

The Energy Efficiency and Conservation Act of 2019 and its implementing rules turn a site's energy use into a compliance matter once it crosses a threshold. A site consuming 500,000 kilowatt-hours a year, counting all fuels on an equivalent basis, is a Type 1 designated establishment; above 4,000,000 it is Type 2. Most factories and many large buildings are one or the other.

The obligations

A certified energy conservation officer for Type 1, or a certified energy manager for Type 2, on the staff.

An annual energy consumption report to the Department of Energy, by fuel and by use.

An energy audit at least every three years, by a certified auditor.

An energy management system, with targets, and an annual utilisation report against them.

What the audit is for

The audit is where the boiler shows up. In most Philippine plants the steam system is the largest single energy use and the least measured. A compliant audit meters it, and what it usually finds is a boiler running below its rated efficiency on a fuel bought by the drum, with condensate going to drain. The law does not oblige the site to act on the findings; the fuel bill does.

The incentives

The Act makes energy efficiency projects eligible for the fiscal incentives of the investment code, and it recognises energy service companies as a route to deliver them. A residue-fired boiler that replaces a fuel-oil one is both an efficiency project and a renewable one, and qualifies under both laws.

The point of the paperwork

The obligations look like administration, and for a site that already measures its energy they are. For the site that does not, the first annual report is the first time anyone has added up what the plant burns. That is the number every decision about the plant's energy supply starts from, and the law's real effect is to make a site produce it.
